OBSTACLES IN PROTECTING THE RIGHT TO PRIVACY AND HONOR OF WOMEN ON THE INTERNET

Abstract

This research aims to (i) analyze the violation of the right to privacy on
the Internet, the foundations and factual reality of this right; (ii) how the
Brazilian legal system protects the right to privacy in relation to computer
crimes and crimes against honor on the internet; and (iii) the figure of women as victims of violations of privacy and attacks against honor in a virtual environment. This is because privacy is a fundamental right enshrined
in the Brazilian Constitution of 1988, which aims to protect the dignity of
the human person, safeguarding their image and intimacy. However, the
scope of the internet is evidenced as a means of scarce inspection, which leads to a scenario in which many rights are violated, privacy being one of them. As for the
intimacy of women, violence in cybernetic territory is even more frequent and intensified by
the intrinsic machismo in society, with results in the exacerbated exposure of sensitive personal data and intimate images without consent. The article seeks, from a qualitative analysis
of Brazilian legislation, general and specific, under the analytical and empirical dogmatic
methodology, to carry out a study on virtual crimes that show the fragility of women’s right
to privacy.
