VIRTUAL HERITAGE IN BRAZIL AND HUMAN DIGNITY
LEGAL AND PRACTICAL CHALLENGES IN POST-DEATH DIGITAL HERITAGE MANAGEMENT

The study aims to understand virtual inheritance succession in Brazil and how virtual assets left when an owner dies are treated. Many of these assets, due to lack of information, legislation or doctrinal consensus, remain in a cyber limbo, causing legitimate heirs to no longer enjoy the property benefits and fruits that these assets can have. In addition to the current legislation approach, a possible solution will be proposed to mitigate the negative effects, which make access to virtual assets difficult when left as an inheritance. There are two problems that guide this study, namely: how does Brazilian legislation deal with the subject? Furthermore, what are the future perspectives on digital inheritance in Brazil, considering the human dignity of the heirs? The deductive method is used, with research in bibliographic and documentary sources
