CLIMATE JUSTICE STRATEGIES: THE CONTRIBUTION OF THE ADVISORY OPINION OF THE INTERNATIONAL COURT OF JUSTICE

Abstract

Due to its anthropogenic causes, felt by all humanity, climate change has proven to be one of the most complex and serious problems for States, requiring all levels of society to reevaluate their respective roles in the global context, with the adoption of public policies that can effectively contribute to containing, mitigating, or adapting the climate system to human life itself and human rights as a whole. In this sense, this article (using a critical-deductive methodology and bibliographical references) analyzes the importance of the international legal framework for climate change and the strategy of initiating a consultation on States' obligations, led by the United Nations General Assembly, involving the International Court of Justice, which issued an Advisory Opinion on the matter, assuming a pioneering stance that represents a milestone in the development of international environmental law
