JUSTIÇA RESTAURATIVA E VIOLÊNCIA DOMÉSTICA E/OU FAMILIAR: CONSEQUÊNCIAS EM RELAÇÕES COMPLEXAS FAMILIARES

Abstract

The present task carries an overview of the study that was developed in the Conclusion Work
carried out for the Law School of the Catholic University of Santos, concerning restorative
justice, with the objective of analyzing the effectiveness in cases involving domestic violence,
in order to evaluate the effects on family relationships, emphasizing the implementation by
the Brazilian Judiciary. That said, it was sought to expose concepts and effects by restorative
justice, as well as showed that it is necessary to address the application in foreign legislation,
tracing a historical evolution of the institute and case analyzes. This work intend to find out
if it is possible for the aggressor and the victim to have contact, even for the welfare of the
rest of the family. If so, how to perform or instrumentalize? Does restorative justice have
positive or negative effects in these situations? Thus, it was concluded by means of qualitative
research method in doctrines, websites, magazines, articles, and academic texts, that
with this alternative method of conflict resolution, there is the possibility of face the family
relationship that that results from it (such as, for example, parents of the offspring), after a case of domestic violence, and to see as the main consequences of this new family format in
complex relationships arising from Family Law.
