Abstract

This article aims to address some of the challenges, theoretical and practical, of contemporary International Law, analyzing technical and current elements relevant to its effectiveness. In addition, the article discusses issues such as the conceptualization of International Law, its humanization process, natural law and voluntarist currents, the prohibition of retrogression and the responsibility to protect in the context of the war between Russia and Ukraine. Aspects related to the humanitarian treatment of refugees are also discussed. The central problem addressed in this study is the effectiveness of International Law in the face of contemporary challenges. As a hypothesis, it is argued that joint efforts and the adoption of humanitarian protection measures can contribute to face these challenges more effectively. As for the applied methodology, this article is based on bibliographical and documentary research, relevant to support the analyzes and arguments presented.
