LANDSLIDES IN BAIXADA SANTISTA AND THE STATE’S SOCIAL AND ENVIRONMENTAL RESPONSIBILITY

Here we address climate change as one of the most pressing dilemmas of the 21st century, profoundly affecting sustainability and global well-being, focusing on Baixada Santista, São Paulo, Brazil. This is an area particularly susceptible to extreme weather events such as landslides and floods. The impact of these socio-environmental disasters and state responsibility is investigated. The question that arises is the possibility of imposing parameters in favor of catastrophes, floods, and landslides in the Baixada Santos region. Based on constitutional interpretation that prioritizes human dignity and using legislation such as Law 12,608/2012 and Law 8,742/1993, this work adopts a critical-deductive methodology. This approach highlights the essentiality of formulating efficient public policies and establishing social control mechanisms, in line with the Cities Statute, aiming at effective action in the face of adversities caused by climate change in the region.
