Abstract

The purpose of this article is to analyze the damage caused to the environment by the fire that took place between the 2nd and the 9th of April 2015 in six fuel tanks of a liquid bulk storage and chemical products storage company in Santos/SP. The fire caused the death of more than nine tons of fish, impacted the local vegetation and emitted air pollutants. After investigations, the Federal Prosecutor’s Office filed a complaint against the company for the practice of three crimes prescribed in the Environmental Crimes Law. The circumstances of the accident, the damage caused to the environment and fishing communities were studied, as well as the decisions in the lawsuit and the signing of the partial conduct adjustment term.
The article proposes an analysis regarding the presence of legal requirements for granting the conditional suspension of the lawsuit. Among the conclusions reached, are the lack of fulfillment of legal requirements for the conditional suspension of the lawsuit and its use as a stimulus to repair the damage, given the urgency of the fishing communities to be compensated and the lack of effectiveness of the Environmental Crimes Law.
