As ÁREAS DESPROTEGIDAS E “PROTEÇÃO” POR MEIO DE SUA INSERÇÃO EM UNIDADES DE CONSERVAÇÃO DA NATUREZA

The creation of Permanent Preservation Areas (APPs), Legal Forest Reserves (RLs), and Nature Conservation Units (UCs) represent the main protectionist formulas contained in national legislation, derived from international experience. All have their own regimes, and there is a general provision in the Federal Constitution (1988), art. 225, §1, III, requiring them to be defined in the various federative spheres. The guiding question is how to protect areas of the national territory, currently the size of the state of Bahia, especially in the Amazon. The direct consequence of this government failure is land grabbing and irregular registration as private property, serving activities contrary to Brazil's commitments, especially in light of Target 11 of the 5th Edition of the Global Biodiversity Outlook (GBO-5), launched by the Secretariat of the Convention on Biological Diversity in Aichi (CBD). refers to protected areas in the face of the obstacles and challenges of an emerging country and was internalized by the Brazilian government in 2013. Goal 11 establishes commitments to the creation of new protected areas and their maintenance, with adequate ecological representation, governance, and connectivity. This work employs the hypothetical-deductive method and bibliographic and documentary methodology for its development. Among the conclusions is the great difficulty the current government has in curbing occupations in these spaces and also in creating new Nature Conservation Units, which would be the most appropriate institution for in situ preservation.
